Rajpal Yadav’s check bounce case has once again come into limelight. Delhi High Court heard the actor’s case today. For a long time, the High Court was trying to intervene in this matter and reach a settlement, but this could not happen. Now Rajpal Yadav has got a big blow from Delhi High Court. The court has sentenced him to 3 months’ imprisonment. In such a situation, the actor will be sent to jail again.
What is the court order?
Delhi High Court has sentenced actor Rajpal Yadav to three months simple imprisonment in all seven check bounce cases. The court ordered that all the sentences would run concurrently, so he would have to serve a total sentence of only three months. The court has also imposed a fine of Rs 1.05 crore in each case. In this way, the total fine in all seven cases comes to Rs 7.35 crore. As per the court order, in each case Rs 1 crore 4 lakh 75 thousand will be paid to the complainant and Rs 25 thousand will be paid to the state. Justice Swarnakanta Sharma said that Rajpal Yadav was given several opportunities to comply with his undertaking given in the court, but he did not comply with it despite getting repeated opportunities.
The court raised questions on Rajpal’s changed stance in the last hearing itself.
High Court Justice Swarn Kanta Sharma had reserved her decision in this case on April 2, which was heard today. The court made it clear that the last attempt at compromise failed. During the last hearing, the actor opposed the settlement plan and made an emotional appeal before the court. The High Court expressed strong displeasure over the changing attitude of Rajpal Yadav regarding repayment of the outstanding loan. The court had said on one occasion, ‘I am not getting answers to my questions. Something else was written in your affidavit and now you are saying something else.
This was the demand of the company
Advocate Avneet Singh Sikka, representing the complainant company, had argued that Yadav cannot escape his responsibility as he has already accepted his conviction. He claimed that no concrete reason was given for the long delay of 1894 days in the amendment petition of the year 2024. The lawyer had further argued that merely completing the jail sentence does not extinguish the financial liability for the bounced cheques. Apart from this, he said that due to non-payment of the outstanding amount despite repeated assurances, the complainant was forced to take legal recourse under Section 138 of the Negotiable Instruments Act. On the suggestion of the court, the complainant company had agreed to take ₹6 crore as final settlement.
Rajpal Yadav did not agree to the agreement
However, Rajpal Yadav rejected the proposal and appeared in person on the last day of the hearing, telling the court that he had already suffered huge financial losses. He claimed that he had already paid a huge amount after selling his property. Apart from this, the court also suggested a structured payment of ₹3 crore within a certain time frame, while clarifying that this is only an advisory and not a final decision. Despite all these efforts, both the parties could not reach any agreement, after which the court adopted a strict stance today.
